Workers' Compensation

The workers' compensation program for state employees is self-insured and Risk and Benefits is responsible for the oversight of the program. A third party administrator (TPA) administers the program and reviews each claim and determines if the injury or illness is covered under workers' compensation. The TPA handles all aspects of claims and also provides loss control services, working closely with state agencies to provide claims management, and injury prevention assistance.

What is Workers' Compensation?

Workers' Compensation is an insurance program that pays medical and disability benefits for work-related injuries and diseases.

Who is Covered?

All New Hampshire state employees are covered for workers' compensation including full-time, part-time and seasonal employees.

Initial Reporting

  • In the event of a work-related injury, an employee must notify their immediate supervisor right away. Don’t wait t — there are time limits that need to be met. Click here to find out what to do if you are injured on the job.
  • Complete a Notice of Accidental Injury or Occupational Disease 8aWCA within 24 hours of the event. Once completed, the notice must then be returned to your supervisor, who will forward it to Human Resources (HR).
  • Human Resources will report the claim to the TPA. You may contact your HR representative if you have any questions regarding your claim.

What Happens Next

  • You will receive a packet in the mail from the TPA which will contain important information regarding your claim.
  • You may receive a call from an adjuster to discuss your claim.
  • The TPA will notify the employee submitting a workers compensation claim within 21 days if the claim has been approved or denied.

Wage Replacement

  • There is a three-day waiting period before being eligible to receive weekly wage replacement benefits. Note: If an employee is medically required to remain out of work for more than fourteen (14) days, they will be compensated for the first three (3) days of disability.
  • Sick or annual leave can be used to supplement your workers' compensation wage replacement benefit. Please see your Agency Human Resource representative for more details.

Medical Benefits

  • If your claim is approved, you will be eligible for the payment of reasonable medical expenses related to your work-related injury consistent with the State's Managed Care Program.

Keep us Updated

If anything changes during your care/treatment, notify your supervisor and your agency Human Resource representative. Notify us:

  • Anytime you receive a new or updated NH Workers' Compensation Medical Form;
  • If you will be returning to work earlier or later than anticipated;
  • If you will be returning to work with restrictions;
  • If you will be returning to work on a part–time schedule;
  • If you are unable to return to work;
  • In advance if you have doctor or therapy assignments.
